*CRITICAL QUESTIONS ANSWERED* — Updated DOL Guidance on FFCRA Paid Leave

The Department of Labor has updated its FAQs with information answering some key questions about the FFCRA’s Expanded FMLA and Emergency Paid Sick Leave.  The new FAQs provide guidance on the following topics:

  • Required documentation (FAQs 15 and 16)
  • Intermittent leaves may be agreed upon between employer and employees (FAQs 20, 21, and 22)
  • Unavailability of FFCRA paid leave during shut downs and furloughs, whether before or after April 1, 2020 (FAQs 23, 24, 25, 26 and 27)
  • Impact of reduction in work hours on FCCRA paid leave (FAQ 28)
  • Requirement to continue health coverage (FAQ 30)
  • Integration of FFCRA paid leave with existing employer paid leave may be agreed upon between employer and employees, but may not be required by the employer (FAQs 31, 32, and 33) [Note: Employers may be required to integrate at an employee’s option under state and/or local law]
